After Reconciliation: Renewing the Case for AI Policy Leadership

The Senate’s decision to remove federal preemption of state artificial intelligence laws from the reconciliation package marks a serious loss for American innovation and long-term global competitiveness. At a time when artificial intelligence is transforming every sector of our economy, the United States has chosen fragmentation over coherence, risk over stability, and political expediency over national leadership.
The goal of federal preemption is straightforward. It would establish a clear national framework that allows developers, researchers, and businesses to innovate without the uncertainty of navigating inconsistent and rapidly changing state regulations. Artificial intelligence is not a local technology. It does not stop at state borders. A model trained in Ohio might be deployed in Arizona and refined by a developer in Massachusetts. In this environment, a patchwork of state laws is not only inefficient, it is unsustainable.
Federal preemption was never about weakening consumer protections. It was about preventing conflicting and difficult to comply with rules that make it impossible for smaller companies and startups to function. States would still have been able to enforce technology-neutral laws related to safety, consumer rights, and child protection. What the preemption provision would have prevented is singling out artificial intelligence for overly broad and sometimes politically motivated restrictions.
By removing this provision, the Senate has sent a message that each state can set its own rules for one of the most transformative technologies of our time. That message creates regulatory confusion. It raises compliance costs. And it places American companies at a disadvantage in the global race to develop safe and responsible artificial intelligence tools. Countries like the United Kingdom, South Korea, and Singapore are building coherent national strategies for AI. The United States is moving in the opposite direction.
We are especially concerned about what this means for national security, smaller developers, public interest researchers, and nonprofit AI labs. Large technology firms may have the resources to comply with fifty different sets of rules. Others do not. The result will be fewer players, less experimentation, and slower progress in areas where artificial intelligence has the greatest potential for public benefit—health care, climate adaptation, national defense, and education.
We also recognize the political pressures that shaped this vote. Some lawmakers expressed concern that federal preemption would prevent states from protecting minors online or responding to legitimate public safety concerns. We share those goals. But those concerns were already addressed in the proposed language, which explicitly preserved the ability of states to enforce general safety laws, privacy protections, and child welfare rules that apply regardless of the technology used.
In rejecting preemption, the Senate has not strengthened public trust in artificial intelligence. It has weakened the ability of Congress to provide the kind of clear, durable rules that Americans deserve. The alternative is a piecemeal regulatory environment where businesses are forced to guess what will be allowed in each jurisdiction and where innovation is slowed by legal ambiguity and administrative burden.
Despite this setback, Alliance for the Future remains committed to pursuing a national policy framework for artificial intelligence. We believe that effective regulation is possible without sacrificing economic growth, scientific progress, or democratic values. We will continue working with members of Congress, federal agencies, and state leaders to support thoughtful and coordinated approaches to AI governance.
Federal preemption is not a fringe idea. It is a practical solution to a predictable problem. Just as we would not expect each state to set its own standards for aviation safety or nuclear research, we should not expect artificial intelligence to be regulated on a piecemeal basis. The stakes are too high, and the technology is too consequential.
We are grateful to the lawmakers who supported the preemption effort and who understand the importance of regulatory clarity in a rapidly evolving field. This is not the end of the road. It is an inflection point. The need for a national AI strategy, including baseline standards and consistent rules, remains urgent. Alliance for the Future will continue to advocate for policies that promote innovation, protect consumers, and ensure that the United States remains the global leader in the responsible development of artificial intelligence.
