Alliance for the Future Urges Inclusion of AI Preemption in Reconciliation Bill

Dear Majority Leader Thune, Minority Leader Schumer, Chairman Cruz, and Ranking Member Cantwell:
As the Senate prepares its version of the reconciliation bill, we respectfully urge you to include the federal preemption language on artificial intelligence that was adopted in the House-passed legislation. This provision is a vital step toward creating a stable and nationally consistent policy framework for AI—one that protects consumers, fosters innovation, and avoids the damaging effects of a fragmented state-by-state regulatory landscape.
More than a thousand AI-related bills are currently pending in state legislatures across the country. Without federal preemption, we risk creating a legal environment in which AI developers and users must navigate conflicting rules in every jurisdiction. The House language offers a practical and balanced solution: it temporarily prevents new AI-specific state laws from taking effect while preserving the authority of states to enforce existing, technology-neutral laws in areas such as consumer protection, civil rights, and public safety.
This approach does not limit legitimate oversight. Instead, it ensures clarity and consistency during a period of rapid technological change. It provides the breathing room needed for Congress to develop thoughtful national standards while reinforcing America’s ability to lead in AI development and deployment amid increasing global competition.
We commend the House for taking this forward-looking step and urge the Senate to do the same. Including this language in the final package will send a clear signal that the United States is committed to leading and innovating in AI.
